Introduction

Checkfluence is an online platform dedicated to collecting and sharing reviews about influencers and their content. By using Checkfluence to search for or publish reviews, you agree to these terms of use ("terms"). If you do not agree to these terms, please do not use our platform. You accept these terms by (a) browsing, accessing the platform, conducting searches, writing a review, or using our platform in any way; or (b) clicking a box, button, or providing any other consent indicating your acceptance.

I. Definitions

You and Checkfluence

The terms "you" or "your" refer to the person who browses, accesses our platform, conducts searches, writes a review, or uses our platform. The terms "Checkfluence," "we," "our," or "us" refer to the Checkfluence entity with which you have a contract under these terms.

Platform

"Our platform" refers to the Checkfluence.com website, including all its subdomains, subdirectories, similar sites, or applications that we manage and make available to you.

Third-party products and services

Our platform may integrate, display, or provide links to third-party products and services. We do not endorse or guarantee these third-party products and services and disclaim any responsibility for them. We do not guarantee the compatibility of our platform with your browser, network, or computer configuration.

II - Using Checkfluence

To publish a review, report a review, or perform other actions (except browsing) on our platform, you must create a user account. Only one personal, non-transferable user account is allowed. To create a user account, you can log in via your Google account or use your email address and the verification link we will send you. Sometimes, your account may be automatically created with your email pre-filled, for example, if an influencer invites you to manage their page with them.

You will need to choose a username visible on the platform whenever you interact with a review or produce user-generated content, including reviews or any other content created by you ("user-generated content"). Your username identifies you to other users. If you use your real name as your username, it may reveal your identity. Your username must not contain:

• Offensive, hateful, discriminatory, defamatory, obscene, or illegal content;
• Misleading terms about your role or status, such as "Admin";
• Promotional messages, including website links;
• Elements belonging to others or a third party, such as another person's name.

You are entirely responsible for managing access to your user account and its use. For example:

• You must not allow anyone else to access or use your user account, and you must not share your login credentials, including your email address and verification link. If you believe any of your user account credentials have been stolen or misused, inform us immediately by contacting [email protected].
• You agree to keep all information associated with your user account (including your email address) accurate and up to date. You can change your username by logging into your user account.
• You are responsible for all activities associated with your user account, including reviews, likes, and any user-generated content.

When accessing or using our platform, you must respect and follow our guidelines and our policies:

When to write a review

Feel free to write a review if you've had a recent and genuine experience with an influencer, whether you're an individual who follows their social media posts or a company that has collaborated with them. We expect you to be well-acquainted with the influencer and their content, ensuring your review accurately reflects your honest opinion. Incentives like discounts or gifts should not influence your review. You can report any influencer or company offering incentives at [email protected]. Reviews help others by sharing your authentic insights, whether through social media engagement, online collaborations, or personal observations. Ensure your review covers experiences from the past year to maintain relevance.

Avoid fake or biased reviews

It is prohibited to create, send, or participate in the collection of fake reviews. By "fake reviews," we mean reviews that do not reflect real knowledge of the influencer and their content or that aim to manipulate the opinions of other users. Ensure your review is based on your own experience and do not write on behalf of others. If you are closely associated with, work for, or compete with an influencer, you should not review them. Never accept incentives to write, alter, or delete a review.

Keep proof of your experience

In a professional context, it's important to retain any documentation such as receipts, order confirmations, or any other relevant records that can verify your experience. You may be asked to provide this proof to substantiate your review.

Be respectful

Always maintain a respectful tone in your interactions. Avoid posting anything harmful, hateful, discriminatory, defamatory, or obscene. Refrain from lying, bullying, blackmailing, making threats, or engaging in illegal activities. Behave respectfully towards Checkfluence employees, partners, clients, and other users. We do not tolerate any form of insults or intimidation towards our employees or users.

Avoid defamation

We aim to balance allowing users to express their opinions while removing content that unfairly damages reputations or causes significant financial loss. The most effective reviews present facts and allow readers to draw their own conclusions. We do not involve ourselves in factual disputes between users and influencers.

No promotions

Do not use our platform for promotional or marketing purposes, whether for yourself or any service, product, or business. Your reviews should be relevant and free from promotional content or links. This isn’t the place for marketing, forming action groups, or including any other type of promotional material.

Protect private information

Reviews are public, so avoid including sensitive personal information or details about others. This includes names, phone numbers, addresses, email addresses, and other identifiable information to respect and protect privacy.

Check the influencer you’re reviewing

To prevent confusion, always ensure you're reviewing the correct influencer. Double-check their social media links to avoid any potential mistakes.

Your user account

You need a user account to post a review. Use your real identity, as your profile should reflect who you are. Your username and profile picture must not be harmful, hateful, discriminatory, defamatory, or obscene. Connect your account to a valid email address for communication purposes.

Edit or delete your review

You have full ownership of your review and can edit, update, or delete it whenever you wish. Feel free to add more details to existing reviews or write new reviews for different experiences. However, refrain from overwhelming an influencer with multiple reviews in a short span of time.

Flagging reviews

Help uphold the platform's integrity by flagging reviews with legitimate concerns. Be fair and consistent when doing so. If your review is flagged for guideline violations, it may be temporarily hidden until corrected. Serious misuse can result in review removal and account deletion. Our system continuously monitors and eliminates suspicious and fake reviews.

These guidelines act as our guiding principles, and we hold the authority to interpret and enforce them. We may revise them as necessary, at any time, without prior notice. Any updates will automatically apply to you without requiring further acceptance or action from you.

Furthermore, you must follow these fundamental rules:

• Use our platform in accordance with these terms of use and our policies.
• Do not compromise the security or integrity of our platform.
• Do not interfere with the functionality of our platform or others' use of it.
• Do not introduce or download viruses or other malicious code onto our platform.
• Do not modify, copy, adapt, reproduce, disassemble, decompile, reverse engineer, or extract the source code of our platform.

IV - Ownership and usage rights

All components on our platform, excluding user-generated content, are owned by us. This ownership encompasses all rights related to the design, compilation, and overall appearance of our platform, including logos, graphics, and trademarks ("our brand"). You agree not to copy, distribute, modify, or use any content from our platform or our brand without our explicit permission.

You retain ownership and responsibility for all user-generated content you publish or transmit on our platform. You must possess all required permissions to create and/or utilize this content. Unless your content breaches our terms of use and is subsequently removed by either us or yourself, it will remain publicly accessible on our platform and any associated third-party services and networks indefinitely.

By generating, submitting, posting, or showcasing user-generated content on our platform, you provide us with a worldwide license to utilize, alter, publish, and display the content without any restrictions or financial remuneration. This license permits us to share your content with other companies or individuals for purposes including, but not limited to, syndication, distribution, promotion, or publication. Additionally, you grant us the authority to initiate copyright infringement proceedings against any party using your content without prior permission.

V - Privacy and data use

The personal data we gather about you through your use of our platform will be handled in accordance with our privacy policy.

We implement reasonable measures to safeguard your confidential information and expect you to do likewise with ours. Both parties commit to securing each other's confidential information to prevent unauthorized third-party access, except when such information is shared with our affiliates or when you provide non-confidential feedback.

VI - Termination and suspension

We may terminate or suspend your access to your user account or filter user-generated content immediately if you violate or threaten to violate these terms and/or our policies.

You can choose to delete your user account at any time, which will result in the removal of all your reviews from our platform.

VII - Liability terms

We are only liable for foreseeable losses and damages up to the amount you have spent on the platform, which we directly caused. We do not guarantee that the platform will be available at all times. The platform is provided "as is," without any warranty of any kind.

VIII - Disputes

Most concerns can be resolved quickly by contacting us at [email protected]. If a resolution is not possible, you and we agree to bring any claim exclusively in the jurisdiction specified in the section on contracting entities and applicable law of these terms.

IX - Additional important considerations

Changes to these terms

We reserve the right to modify these terms at any time without notice. It is your responsibility to regularly review the most recent version of these terms, as any modification will be immediately applicable.

Changes to our platform

We may update and modify our platform at any time without notice.

Events beyond our control

We are not responsible for any failure or delay in fulfilling our obligations under these terms resulting from any event or circumstance beyond our reasonable control.

Language
